Terms of Service

By accessing or using Tune Tavern ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

You must be at least 13 years old to use Tune Tavern. You are responsible for maintaining the security of your account credentials. You may not share your account with others or create multiple accounts. You are responsible for all activity that occurs under your account.

When creating an account, you must provide accurate information and select a role: Host, Artist, or Listener. You may change your role or hold multiple roles from your account settings.

You retain full ownership of any content you upload to Tune Tavern, including audio files, profile information, and written content. By uploading content, you grant Tune Tavern a limited, non-exclusive license to host, display, and stream your content within the context of the Platform's services (review sessions, discovery feeds, artist profiles, and Song Wars).

You represent and warrant that you have all necessary rights to the content you upload and that your content does not infringe on any third party's intellectual property rights.

Artists may purchase skip credits to advance their position in a host's review queue. Skip tiers and pricing are set by individual hosts within platform guidelines.

• All skip purchases are final and non-refundable. Once a skip credit is used to enter a queue position, no refund will be issued regardless of whether the review takes place.
• Unused skip credits may be refunded within 7 days of purchase if they have not been applied to any queue.
• Tune Tavern retains a 5% platform fee on all skip revenue.
• Hosts receive 95% of skip revenue generated during their sessions, paid out through Stripe Connect.

The revenue split for all paid transactions on Tune Tavern is:

• Host share: 95% of skip purchase revenue
• Platform fee: 5% retained by Tune Tavern

Payouts are processed through Stripe Connect. Hosts must connect a valid Stripe account to receive payouts. Tune Tavern is not responsible for delays caused by Stripe or the host's financial institution.

Tune Tavern offers free and paid subscription tiers. Paid plans (Headliner for hosts, Artist Pro for artists) are billed monthly. You may cancel at any time; access continues through the end of the billing period. No prorated refunds are given for partial months.

You may not upload or share content that:

• Infringes on copyrights, trademarks, or other IP rights
• Contains hate speech, threats, or harassment
• Includes explicit sexual content or graphic violence
• Promotes illegal activities or substances
• Contains malware, viruses, or harmful code
• Impersonates another person or entity
• Manipulates ratings, reviews, or Song Wars outcomes

You may not use bots, scripts, or automated tools to interact with the Platform without prior written permission. Vote manipulation, fake accounts, and review fraud are strictly prohibited.

Tune Tavern respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, submit a DMCA takedown notice to:

Your notice must include:

• Identification of the copyrighted work
• Identification of the infringing material and its location on the Platform
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

Repeat infringers will have their accounts terminated. Counter-notices may be filed in accordance with the DMCA.

Song Wars is a feature where tracks compete head-to-head with audience voting. By entering Song Wars, you agree that results are determined by audience votes and are final. Tune Tavern does not guarantee any specific outcome or exposure from Song Wars participation.

Tune Tavern is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, accuracy of ratings, or any specific financial outcome from using the Platform.

To the maximum extent permitted by law, Tune Tavern shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

We may suspend or terminate your account at our discretion if you violate these Terms, engage in prohibited conduct, or for any reason with reasonable notice. Upon termination:

• Your access to the Platform will be revoked
• Pending payouts will be processed within 30 days
• Your uploaded content will be removed within 90 days
• You may request an export of your data before account deletion

You may delete your account at any time from your account settings.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.
